J U D G M E N T

I do not propose to go into the merits of the matter. The grievance of the petitioner is that his request to the Panchayat for permission to lay concrete slabs over a panchayat drain is not being considered by the Panchayat at all on account of the influence exercised by one Elias and others.

Having regard to the submissions of Mr.M.J.Thomas, counsel for the petitioner and the various grounds raised in the Writ Petition and also the documents placed on record, I am of the view that this Writ Petition can be disposed of at this stage itself, even without issuing notice to the respondents, issuing the following directions:

The Panchayat will take up Ext.P2, consider the same in the light of the various grounds raised in the Writ Petition and take an early decision on Ext.P2. If the Panchayat is inclined to hear the petitioner in the matter, the Panchayat will hear the petitioner and anybody else who according to the Panchayat will also be concerned in the matter. The decision taken on Ext.P2 will be communicated to the petitioner within two weeks of the decision being taken.

The Writ Petition is disposed of as above.
