The petitioner is before the Court calling in question the proceedings in S.C.No.5010/2025 registered for offences punishable under Section 108 of the BNS/Section 306 of the IPC inter alia .

Heard Sri.R.Shashi Kumar, learned counsel appearing for the petitioner, Sri.Rashmi Patel, learned HCGP appearing for respondent No.1, Smt.Keerthi Reddy, learned counsel appearing for respondent No.2 and have perused the material on record.

The parties to the lis during the subsistence of the proceedings have entered into a settlement and would want to terminate the proceedings on the said settlement.

Learned HCGP appearing for the respondent-State

¶32

would however not accept the settlement to be entered into and closing of the proceedings only on the score that Section 306 of the IPC is an offence which is punishable up to 10 years.

Learned counsel for the petitioner would seek to place reliance upon the judgment of the High Court of Delhi in Crl.M.C.3383/2022, disposed on 01.08.2022, wherein the Delhi

High Court has accepted the settlement and terminated the proceedings thereon.

A perusal at the summary of the charge sheet would clearly indicate that the petitioner is a stranger to the allegation and without any rhyme or reason, has been drawn into the web of crime. In that light, even if further proceedings

are permitted against the petitioner, there is no chance of him getting convicted, as the law is goaded against the prosecution.

In that light, I deem it appropriate to accept the settlement and

terminate the proceedings qua the petitioner. The Joint Compromise Petition filed by parties to the lis reads as follows:

"The above Writ Petition is filed seeking quashing of the complaint dated 07.01.2024, FIR in Crime No.03/2024 of Kolala Police Station and the charge-sheet filed in SC No.5010/2025 pending before the Hon'ble IV Additional District and Sessions Court, Madhugiri, for the offences punishable under Sections 306 and 506(8) of the Indian Penal Code.

The 2nd Respondent is the complainant and husband of deceased Lakshmidevi.

The parties submit that after registration of the case, Intervention of elders, relatives and well-wishers took place and the parties have amicably resolved all their disputes and misunderstandings.

The 2nd Respondent submits that at the time of lodging the complaint and during investigation, he was under severe grief, emotional distress and mental shock due to the sudden and unfortunate death of his wife Lakshmidevi.

The 2nd Respondent further submits that the deceased was facing emotional stress arising out of family circumstances, particularly concerns relating to the future of their daughter Deepika, her matrimonial difficulties, her desire to continue her education and the disputes prevailing within the family regarding such issues.

Upon careful consideration of all the facts and circumstances, the 2nd Respondent submits that he does not attribute any act of instigation, intentional provocation or abetment to the petitioner in relation to the death of his wife.

The 2nd Respondent further submits that he has no objection whatsoever for quashing the complaint, FIR, charge-sheet and all further proceedings pending against the petitioner in SC No.5010/2025.

The petitioner and Respondent No.2 submit that they have resolved disputes voluntarily and without any force, coercion, undue influence or pressure from any person.

The parties submit that continuation of the criminal proceedings against the petitioner would serve no useful purpose and would result only in unnecessary hardship and prolonged litigation.

The parties therefore jointly pray that this Hon'ble Court may be pleased to exercise its extraordinary jurisdiction under Articles 226 and 227 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, and quash the proceedings in order to secure the ends of justice.

WHEREFORE, the Petitioner and Respondent No.2 most respectfully pray that this Hon'ble Court may be pleased to:

a) Record the present compromise between the Petitioner and Respondent No.2;

b) Allow the Writ Petition;

¶58

c) Quash the complaint dated 07.01.2024, FIR in Crime No.03/2024 and the charge-sheet in SC No.5010/2025 pending on the file of the Hon'ble IV Additional District and Sessions Court, Madhugiri, insofar as the petitioner is concerned;

d) Pass such other order or orders as this Hon'ble Court deems fit in the interest of justice and equity. "
