Petitioners are before this Court seeking for the following reliefs:

a. Issue a Writ of Mandamus to the Mysore Milk Union to recall the tender by retaining the flexibility in rules and regulations provided for the successful bidders, which provides the interested contractors to participate in the bidding.

b. To cancel the tender announced by the Mysore Milk Federation on 30.5.2025 in KMF:2025-26/SE3483 ANNEUXRE B.

c. The called fresh retender must be conducted in a legal, fair and non- arbitrary manner.

A memo for withdrawal dated 11.07.2026 has been filed signed by the petitioners and counsel for the petitioners, which reads as under:

" In the above case the petitioners has challenged the tender proceedings. Now the respondent has again called for retender, on petitioners approaching them they informed that petitioners cannot participate unless the above is withdrawn.

Hence, the petitioners decided to participate and negotiate with the respondents withdrawing the above petition.

Wherefore the petitioners pray that this Hon'ble Court be pleased to permit the petitioners to withdraw the above petition reserving the liberty to challenge the same if required later, in the interest of justice. "
