ORAL ORDER

Petitioner is before this Court seeking for the following reliefs:

a. Call for records in respect of request for proposal/Notice Inviting Tender bearing BID No. No . ¸ÀPÀE 18 JArJ¸ï 2026 ¨ÉAUÀ¼ÀÆgÀÄ dated 23.04.2026 issued by the Respondent No.-2, Executive Director, Karnataka Residential Institutions Society, Bangalore vide Annexure-A.

b. Issue a writ of Mandamus, order or direction in the nature of writ directing the Respondent No-2, Executive Director, Karnataka Residential Institutions Society, Bangalore to consider the Representations dated 08.05.2026 & 30.05.2026 vide Annexure-D, Annexure-F & F1 respectively and in the interest of justice and equity.

c. Issue a writ of Certiorari, order or direction in the nature of writ to Set aside the undated rejection of Bid of the Petitioner vide Annexure-E and consequently reconsider the Technical Bid of the Petitioner vide Annexure-B in the interest of justice and equity.

d. Issue a writ of Certiorari, order or direction in the nature of writ to Set aside the Corrigendum with respect to the eligibility criteria 2i, eligibility criteria 2iii and eligibility criteria 3i of Request for proposal / tender notification issued by the Respondent No.2 vide Annexure-C in the interest of justice and equity.

e. Pass such other order as this Hon'ble Court deems fit to grant based on the facts and circumstances of the case, including the cost of the proceedings, in the ends of justice and equity.

Learned counsel for the petitioner submits that the above petition has been rendered infructuous and a memo has been filed by the petitioner and counsel for the petitioner, which reads as under:

" The Petitioner above named most respectfully submits that the present petition is filed challenging the Tender Notification Request for proposal / Notice Inviting Tender bearing BID No . ¸ÀPÀE 18 JArJ¸ï 2026 ¨ÉAUÀ¼ÀÆgÀÄ dated 23.04.2026 issued by the Respondent No-2, Executive Director, Karnataka Residential Institutions Society, Bangalore vide Annexure-A. However, the Respondent No. 2 has now issued a fresh Tender Notification dated 03.07.2026 by withdrawing the impugned tender notification. Hence, the present Petition has become infructuous and does not survive for consideration. " 3. Accepting the said memo and the submission of the counsel for the petitioner, the petition is dismissed as having become infructuous .
