The petitioners are before this Court calling in question proceedings in C.C.No.1551/2023, pending before the Additional Civil Judge and JMFC, Kundapura, for the offences punishable under Sections 498A, 504 r/w. 34 of the IPC.

Learned counsel for the petitioners and respondent No.2 in unison submit that the parties to the lis were before the family court in M.C.No.135/2025 and have settled their matrimonial dispute amicably by drawing up certain terms and conditions and therefore, they are before this Court seeking

quashment of the proceedings by permitting them to compound the offences. They submit that the couple have obtained a decree of dissolution of marriage. The parties have filed an application under Section 482 r/w. 320 of the Cr.P.C., separate affidavits of all the parties, order sheet of the family Court and the memorandum of settlement under Section 89 of the CPC r/w. Rules 24 and 25 of the Karnataka Civil Procedure (Mediation) Rules, 2005, before this Court.

The application reads as follows:

“That for the reasons stated in the accompanying affidavit, the petitioners & respondent No.2 above named most respectfully prays that this Hon’ble Court may be pleased to permit the parties to compound the offence, consequently quash the proceedings in C.C.No.1551/203 pending on the file of Addl. Civil Judge and JMFC, Kundapura for the offence punishable U/s. 498(A), 504, r/w section 34 of IPC, against the petitioners, in view of the fact that the matrimonial dispute between the petitioner No.1 & respondent No.2 herein is already settled before the learned trial court / family court as per the memorandum of settlement arrived between the parties with a condition that the complainant / respondent No.2 has no objection to quash the chargesheet pending against the petitioners. Therefore, it is prayed to permit the parties to compound the offence, consequently quash the proceedings in C.C.No.1551/2023 pending on the file of Addl. Civil Judge and JMFC, Kundapura for the offence punishable U/s 498(A), 504, r/w. section 34 of IPC, against the petitioners, in the interests of justice & equity.”

In the light of the fact that the parties have arrived at settlement and since it is a marital dispute, I deem it appropriate to accept the application and terminate the proceedings against the petitioners, as the allegations are not against the State.
