The petition is preferred by the husband calling in question an order of the concerned Court which directs maintenance of ₹4,000/- granted to the wife and the child. The said order of maintenance is called in question before the Court of Sessions in Crl.R.P.No.5016/2023.

The main ground of the learned counsel appearing for the petitioner is that the order is passed ex parte without hearing the petitioner and therefore, the order should be interfered with.

Both the Courts, by rendering cogent reasons as to why the husband should part with ₹4,000/a month as maintenance to the wife and the child, have so directed while

the proceedings are pending before the concerned Court. Since this is an interim maintenance, there is no warrant of interference at this stage of the proceedings. The petitioner shall comply with the order of maintenance of ₹4,000/-, if not already complied and clear the arrears and place it before the concerned Court. All contentions can be urged before the concerned Court at the appropriate time.
