The petition is filed seeking following reliefs:

(i) Issue a writ in the nature of certiorari quashing the endorsement/communication dated 17.09.2025 issued by Respondent No.2 vide SBI/SARB/MKC/ASJ/2025-26/332 produced at (ANNEXURE-A)

(ii) To set aside the sale of e- auction dated 26.08.2025 as stated by the Respondent No.2 in communication dated 17-09-2025

(iii) Direct the Respondents to issue sale notice in the name the petitioner after receiving the balance amount from the petitioner.

(iv) Grant such other further relief as may deem fit in the circumstances of the case.

Counsel for the respondents submits that the sale E- auction notice dated 26.08.2025 has been given effect to and the property has been sold, as there was no interim order passed by this Court. Counsel, therefore, submits that nothing survives for consideration in the petition and the petition may be dismissed.

Taking note of the submission that the sale E-

auction notice dated 26.08.2025 has been given effect to and the property in question has already been sold, nothing survives for consideration in the present petition. Moreover, the prayer sought in the writ petition cannot be granted under writ jurisdiction. Hence, I decline to exercise power under writ jurisdiction. Accordingly, the writ petition is dismissed .
