registered by the respondent as against the petitioner herein, who is arrayed as accused. During the pendancy of the present writ petition, the learned Magistrate has passed the order dated 04.06.2026 whereby he has taken cognizance for the offences punishable under Sections 324, 329, 351 & 352 of BNS, 2023 thereby rendering the present writ petition infructuous.

The petitioner seeks the leave of this Hon'ble Court to permit him to withdraw the present writ petition with the liberty to challenge the aforesaid order dated 04.06.2026 and the consequent proceedings arising out of the above referred private complaint in PCR No.8199/2025.
