Heard Sri V.R. Gurudath, learned counsel appearing for the petitioner.

This petition is filed by the plaintiff in O.S. No.80/2020 pending on the file of the Senior Civil Judge, Challakere, Chitradurga, seeking a writ of mandamus for expeditious disposal of the suit.

Sri V.R. Gurudath, learned counsel appearing for the petitioner, persuaded this Court to peruse the order sheet of the trial Court and to issue directions for expeditious disposal. On examination of the order sheet, it appears that the

suit is at the stage of cross-examination of PW.1 and that multiple adjournments have been granted for the said purpose as PW.1 was not available for cross-examination. When the petitioner has not cooperated before the trial Court for the early conclusion of the suit, it is not open to the petitioner to seek a writ of mandamus for expeditious disposal. However, having regard to the age of the parties involved in the suit, the nature of the suit being one for partition and separate possession, and also considering the fact that the suit is of the year 2020, this Court is inclined only to request the trial Court to dispose of the suit expeditiously without granting unnecessary adjournments.

4. Accordingly, the writ petition stands disposed of .
