THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO QUASH THE GRANT OF VISITATION RIGHTS OF THE WARD MASTER AHAAN ULLEGADDI TO PETITIONER NO.1 BY MODIFYING THE JUDGMENT AND DECREE DATED 28.02.2026 PASSED BY THE HON'BLE COURT OF THE II ADDITIONAL PRINCIPAL JUDGE FAMILY COURT AT BENGALURU IN M.C. NO.919/2026 AT ANNEXURE - A AND QUASH THE FOLLOWING PORTION- IN ADDITION TO THE TERMS AND CONDITIONS OF THE MEDIATION SETTLEMENT AGREEMENT, THE 1ST PETITIONER FATHER IS AT LIBERTY TO VISIT THE MINOR CHILD MASTER AHAAN ULLEGADDI WHENEVER HE WISHES WITH PRIOR INTIMATION TO THE 2^ND PETITIONER MOTHER CONVENIENT TO THE MINOR CHILD WITHOUT DISTURBING HIS ACADEMICS AND ETC.

The petitioners are before this Court being aggrieved by the order dated 28.02.2026 passed in M.C No.919/2026 by the II Additional Principal Judge, Family Court, Bangalore with regard to the grant of visitation rights.

Facts of the case:

The petitioners have filed a petition under

Section 13-B of the Hindu Marriage Act for dissolution of marriage by way of mutual consent. The petitioners had already arrived at an amicable settlement in terms of the said petition in which the petitioner No.1 had given up his rights with respect to the custody and visitation rights of his son Master Ahaan Ullegaddi and petitioner No.2 had given up her right of claiming any maintenance for herself and her son and also had given up permanent alimony. The petitioners appeared before mediation center on

19.02.2026 and the matter was settled. Thereafter, the matter was posted to 24.02.2026 at 3.00 p.m., regarding the visitation rights of petitioner No.1 even though petitioner No.1 had stated that he does not intend to exercise the visitation rights. The Family Court, on 28.02.2026 allowed the petitioner filed under Section 13-B of the Hindu Marriage Act and passed orders on visitation rights. Hence, the petitioners are before this Court to modify the said order.

The learned counsel for the petitioners submitted that the Family Court erred in passing the order insofar as granting of visitation rights of the child to petitioner No.1. It is submitted that the findings recorded in paragraph Nos.3 and 4 of the order dated 28.02.2026 are improper, therefore, the same ought to be reviewed. Therefore, the learned counsel for the petitioner seeks modification of the order dated 28.02.2026 and prays to allow the petition.

On considering the submissions of learned

counsel for the petitioners, it appears that the Family Court, vide order dated 28.02.2026 allowed the petition in terms of the settlement which reads as under:

"The present petition filed by the petitioners under Section 13-B of the Hindu Marriage Act of 1955 is hereby allowed in terms of the mediation settlement agreement.

Consequently, the marriage between the petitioners that was solemnized on 12.06.2015 at G.R.Kalyana Mantapa, Bhadrapppa Layout, Bengaluru-560 094 as per Hindu rites and customs is hereby dissolved by a decree of divorce.

In the result, the marriage between the petitioners that was registered on 04.07.2015 in the office of the registrar of Marriages, Byatarayanaputa, Bengaluru vide marriage No.BYP-HM228-2015-16 and stored in CD.No.BYPM27 is hereby conceled.

The mediation settlement agreement shall form part of the decree.

In addition to the terms and conditions of the mediation settlement and conditions of the mediation settlement agreement, the 1^st petitioner-father is at liberty to visit the minor child Master.Ahaan Ullegaddi whenever he wishes with intimation to the 2^nd petitionermother convenient to the minor child without disturbing his academics."

On hearing the submissions of the learned

counsel appearing for the petitioners, the impugned order dated 28.02.2026 is hereby set aside and the matter is remanded back to the Family Court for fresh consideration with regard to visitation rights by considering the terms and conditions entered into between the parties in the mediation agreement dated 19.02.2026.

In view of the same, the matter is remitted back

to the Family Court for fresh consideration and pass appropriate order in accordance with law.

Accordingly, I proceed to pass the following:-

i. Writ petition is disposed of .

ii. The order rendered by the Court of II Additional

Principal Judge, Family Court, Bengaluru in M.C.No.919/2026 dated 28.02.2026 is hereby set aside.

iii. The matter is remanded back to the Family Court to consider the same afresh and to pass orders by considering the terms and conditions entered into between the parties in the mediation agreement dated 19.02.2026.
