The petitioner’s land was notified by the Government as being under unauthorized occupation, pursuant to which an auction was conducted, the requisite amount was paid by the petitioner, and thereafter, occupancy rights were granted by issuance of Form No.7 (Saguvali Chit) dated 12.05.2005.

The grievance of the petitioner is that despite issuance of Saguvali Chit in his favour as early as on 12.05.2005, respondent No.2 failed to enter his name in the record of rights.

Learned Additional Government Advocate appearing for the respondents submits that no representation seeking mutation of name has been submitted by the petitioner before the competent authority and that, in the absence of such a request, the authorities have not considered the matter.

Having regard to the submissions made by the learned Additional Government Advocate appearing for the respondents/State, the writ petition could be disposed of reserving liberty to petitioner to submit a representation seeking appropriate relief.

i. The writ petition is disposed of.

ii. The petitioner is at liberty to submit a representation seeking mutation of his name in the record of rights within a period of two weeks from the date of receipt of copy of this order.

iii. On receipt of such representation, respondent No.2 shall consider the same and pass appropriate orders in accordance with law, within a period of four weeks thereafter.
