Learned counsel for the appellant has filed a

memo.

The memo reads as under:

"The Appellant submits that the Registry has raised an Objection on the maintainability of the above Miscellaneous First Appeal and, on verification, it is submitted that a Writ Petition ought to have been filed instead of the Appeal.

The Respondent No.2 has also expressed that she would like to join with the Appellant herein to file the Writ Petition.

This Honourable Court may kindly permit the conversion of this Appeal into a Writ Petition, or, in the alternative, may kindly permit withdrawal of this Appeal with liberty to file a Writ Petition on the same Cause of Action with further liberty to the second Respondent to join as a Petitioner in the said Petition.

If this Honourable Court were to permit withdrawal of this Appeal with liberty as prayed above instead of leave to convert this Appeal into a Writ Petition, the Registry may kindly be directed to return the documents filed along with this Appeal."
