Chickabanavara Traffic Police Station, Bengaluru City, for the offences punishable under Sections 281, 105 of BNS, 2023, and Section 185 of the Motor Vehicles Act, 1988, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail.

Heard the learned Counsel for the parties.

FIR in Crime No.51/2026 was registered by Chickabanavara Traffic Police Station, Bengaluru City, for the aforesaid offences against the petitioner herein based on the first information dated 25.04.2026 received from Guruprasad. In the said case, petitioner was arrested on 25.04.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.4128/2026 was rejected on 02.05.2026. Therefore, he is before this Court.

First information in the present case is filed by the son of

deceased Kanya Prakash. A reading of the averments found in the first information would go to show that the first informant is

a hear-say witness. After coming to know about the accident in question in which his mother was injured as a result of the car which was driven by the petitioner in a rash and negligent manner dashing against her, the first informant had approached the police.

A reading of the material on record would go to show that petitioner who was the driver of the offending car bearing registration No.KA-04-MU-8451 himself had tried to shift the victim to the hospital. But in the hospital, they had declared that the victim was brought dead. Therefore, a doubt arises whether the petitioner had consumed alcohol beyond the permissible limits. The question whether petitioner was driving the vehicle in a rash and negligent manner is to be proved in a full-fledged trial. Major portion of the investigation is completed. The alleged offences are not punishable with death or life imprisonment. Petitioner is aged 62 years and he has no other criminal antecedents. Under the circumstances, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order:

The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.51/2026 registered by Chickabanavara Traffic Police Station, Bengaluru City, for the offences punishable under Sections 281, 105 of BNS, 2023, and Section 185 of the Motor Vehicles Act, 1988, subject to the following conditions:

a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;

b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;

¶36

c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;

¶37

d) The petitioner shall not involve in similar offences in future.
