City Civil and Sessions Judge, (FTSC-III), Bengaluru City, arising out of Crime No.261/2025 registered by Adugodi Police Station, Bengaluru, for the offence punishable under Section 65(1) of BNS, 2023 and Section 6 of POCSO Act, 2012 is before this Court under Section 483 of BNSS, 2023 seeking regular bail.

Heard the learned counsel for the petitioner and

learned Additional SPP appearing on behalf of respondent no.1- State.

FIR in Crime No.261/2025 was registered by

Adugodi Police Station for the aforesaid offences against the petitioner based on the first information dated 19.11.2025 received from respondent no.2, who is the mother of victim girl. During the course of investigation, petitioner was arrested on 19.11.2025 and remanded to judicial custody. After completing investigation, charge sheet has been filed in the present case as against the petitioner, who is arraigned as accused in the chargesheet. His bail application filed before the trial Court in Crl.Misc.No.290/2026 was rejected on 28.01.2026. It is under these circumstances, petitioner is before this Court.

In the first information dated 19.11.2025, mother of the victim girl has stated that the petitioner who is the son of her uncle was staying in her house. She has

alleged that, petitioner with a promise to marry her minor daughter had sexual intercourse with her and thereafter left the house. Subsequently, her minor daughter had complained of stomach pain and when she enquired, her minor daughter allegedly informed about the act committed by the petitioner. It is under these circumstances she had approached the Police and based on her first information, FIR was registered against the petitioner in Crime No.261/2025 for the aforesaid offences.

Petitioner aged 22 years was arrested on

19.11.2025 and remanded to judicial custody. During the course of trial, the first informant has been examined in the present case as PW1 and the victim girl has been examined as PW2.

Learned counsel for the petitioner has

submitted that the victim girl has not supported the case of Prosecution during the course of investigation. On the

other hand, victim has stated that the petitioner has not misbehaved with her in any manner.

Be that as it may, the fact remains that

material chargesheet witnesses have already been examined in the present case and therefore, there cannot be any apprehension that petitioner may tamper with the said witnesses. The petitioner, who is a youngster has no other criminal antecedents and his continued detention amongst the hard core criminals, may have an adverse impact on his career.

Under the circumstances, I am of the opinion that prayer made by the petitioner for grant of regular bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following:

The petition is allowed .

The petitioner is directed to be enlarged on bail in Spl.C.C.No.9/2026 pending before the Court of III Addl.

City Civil and Sessions Judge, (FTSC-III), Bengaluru City, arising out of Crime No.261/2025 registered by Adugodi Police Station, for the offence punishable under Section 65(1) of BNS, 2023 and Section 6 of POCSO Act, 2012, subject to the following conditions:

a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, out of which, one shall be local surety to the satisfaction of the jurisdictional Court;

b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
