The petitioner - accused No.2 is before this Court calling in question registration of a crime in Crime No.81/2024, pending before the 8^th Additional Chief Metropolitan Magistrate Court, Bengaluru, for the offences punishable under Sections 34, 324, 420 and 506 of the IPC.

Learned counsel for the petitioner and respondent No.2 would in unison submit that during the subsistence of these proceedings, the parties to the lis have entered into settlement amongst themselves by drawing up certain terms and conditions. The parties have filed a joint application under Section 359 r/w. 528 of the BNSS, 2023 along with affidavits of

both the parties seeking permission to compound the offences, before this Court.

The joint application reads as follows:

“2. In view of the settlement between the parties, the Respondent No.2 undertakes to withdraw the all the cases filed against the petitioner including the present case, whatever allegations is made by the complainant in Cr. No.81/2024 of J.C. Nagar P.S. for the alleged offences under section 420, 324, 506, 34 of IPC which is pending on the file of VIII ACJM, Bengaluru City against the petitioner is withdrawn and 2nd respondent has no objection to quash the proceedings in the above against the petitioner.

3. The Petitioner and Respondent No.2 submits before this Hon'ble court that the above application is filed without any force, coercion or undue influence for any person/s.

4. The Petitioner and 2^nd Respondent submits before this Hon'ble court may be pleased to compound the offences and quash the proceedings in of J.C.Nagar P.S. Cr No.81/2024, under section 420, 324, 506, 34 of IPC which is pending on the file of VIII ACJM, Bengaluru City.

Wherefore the Petitioner and respondent No.2 prays before this Hon'ble court may be pleased to quash the proceedings in Cr. No. No.81/2024, of J.C. Nagar P.S. for the offences under section 420, 324, 506, 34 of IPC which is pending on the file of learned VIII ACJM, Bengaluru City in the interest of justice.”
