Learned counsel for the petitioner has moved a memo

seeking permission to withdraw the petition.

The memo reads as follows:

“ MEMO FOR WITHDRAWAL

The Petitioners herein have preferred the present Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita seeking quashing of the baseless, malicious, and untenable criminal proceedings initiated against the Petitioners through the Statement rendered by the Respondent No. 2, which has resulted in registration of the First Information Report (FIR) dated 03.12.2025 in proceedings bearing Crime No. 244 of 2025 against the Petitioners for offences punishable under Sections 54, 109(1), 115(1), 118(1), 127(2), 189(2), 190, 324(4), 329(4), 351(2) and 352 of the Bharatiya Nyaya Sanhita, 2023. In view of the foregoing charge sheet has been filed against the petitioners, the present memo is preferred intending to withdraw the present petition with liberty to challenge the charge sheet in order to protect the rights of the Petitioner and prevent irreparable injury in the interest of justice.”
