This petition is filed by accused No. 3 under Section 483 BNSS praying to grant bail in Cr.No.375/2025 of Bagepalli Police Station, registered for offences under Sections 109(1), 123, 61(2) read with 3(5) of BNS.

Heard learned counsel for the petitioner and learned HCGP for respondent/State.

Learned counsel for petitioner would contend that

the name of the petitioner is not there in the complaint and FIR. The petitioner came to be implicated on the basis of voluntary statement of accused Nos.1 and 2. The allegation against the petitioner is that he gave poisonous fruit powder to accused Nos.1 and 2. The said poison given by this petitioner has been mixed in the food by accused No.1. The petitioner is aged 63 years. The petitioner is not required for further custodial interrogation and he is in judicial custody since 14.11.2025. There are

no criminal antecedents of the petitioner. With this, she

prayed to allow the petition.

Per contra , learned HCGP would contend that the petitioner has given poisonous fruit powder to accused Nos.1 and 2. The said plant is found grown in the backyard of accused No.3/petitioner herein. The investigation is in progress. If the petitioner is granted bail, there are chances of him hampering the investigation and tampering the prosecution witnesses. With this, he prayed to reject the petition.

Having heard the learned counsels, the Court has perused the FIR, complaint and other materials placed on record.

As per averments of the complaint, accused No.2 is having enmity with the complainant and her family members. Accused No.1 used to go to the house of complainant and talked with them. Accused No.1 came to the house of complainant and in the guise of drinking water went to kitchen and mixed some powder in the food

and complainant and her family members who ate the said food have become indisposed and they were admitted in the hospital. The name of this petitioner is not found in the complaint/FIR. The name of the petitioner has been implicated based on the voluntary statement given by accused Nos.1 and 2. Allegation against the petitioner is that he gave poison fruit powder to accused No.2 who gave it to accused No.1. The petitioner is aged 63 years and he is in judicial custody since 14.11.2025. As major portion of the investigation is over, the petitioner is not required for custodial interrogation. There are no criminal antecedents of the petitioner.

Considering the above aspects, the petitioner has made out a case for grant of bail with conditions. In the result, the following:

The petition is allowed. The petitioner is granted bail in Crime No.375/2025 of Bagepalli Police Station, subject to following conditions:

(i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for the like-sum to the satisfaction of the jurisdictional Court.
