This petition is filed by sole accused under Section 482 of Bharatiya Nagrika Suraksha Sanhita, 2023 praying to grant anticipatory bail in Crime No.164/2025 of Vijayanagar Police Station, registered for offences punishable under Sections 120B, 420, 504 and 506 of Indian Penal Code.

Heard learned counsel for petitioner and learned High Court Government Pleader for respondent - State.

Learned counsel for petitioner would contend that, the allegation against the petitioner in the compliant is that, even after receipt of Rs.24,00,000/- for supply of China made furniture in the year 2017, he has not

supplied the said furniture and cheated the complainant. The said alleged incident is of the year 2017 and the complaint has been filed in the year 2025. The dispute is of civil nature and offences alleged are not attracted. The petitioner is ready to cooperate with the Police in investigation and abide by any conditions to be imposed by this Court. With these, he prayed to allow the petition.

Per contra, learned High Court Government Pleader for respondent would contend that, the petitioner is required for custodial interrogation. With these, he prayed for dismissal of the petition.

Having heard the learned counsels appearing for parties, the Court has perused the FIR, complaint and other materials placed on record.

The petitioner is a relative of the complainant. The petitioner is alleged to have received Rs.24,00,000/in the year 2017 for supply of China made furniture. The petitioner is alleged to have not supplied the said furniture

and cheated the complainant. It is submitted that the matter is civil dispute and offences alleged are not attracted. The petitioner has undertaken to cooperate with the Police in investigation and abide by any conditions to be imposed by this Court. The offences alleged against the petitioner are not punishable either with death or imprisonment for life. There are no criminal antecedents of the petitioner.

7. Considering all the above aspects, the petitioner

has made out a case for grant of anticipatory bail with conditions. In the result, the following;

The Criminal Petition is allowed . The petitioner is granted anticipatory bail in Crime No.164/2025 of Vijayanagar Police Station and is ordered to be released on bail in the event his arrest, subject to following conditions:

i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the

like-sum to the satisfaction of the Investigating Officer.

ii) The petitioner shall voluntarily appear before the Investigating Officer within 15 days from this day and execute bail bond and furnish surety.

iii) The petitioner shall cooperate with the Investigating Officer in investigation

iv) The petitioner shall appear before the Investigating Officer whenever called for.

¶50

v) The petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, so as to dissuade him from disclosing such facts to the Court or to any Police Officer or tamper with the evidence.
