ORAL ORDER

The petitioners are before this Court calling in question the proceedings in C.C.No.28998/2024 registered for the offences punishable under Section 354 of the Indian Penal Code, 1860 ('the IPC' for short).

Heard Sri. Vinod N., learned counsel appearing for the petitioners, Sri. Vinay Mahadevaiah, learned High Court Government Pleader appearing for respondent No.1, Sri. Ramu V., learned counsel appearing for respondent No.2 and have perused the material on record.

During the pendency of these proceedings, it transpires that the parties to the lis have entered into a settlement and have placed on record such settlement along with the joint affidavit. Terms of settlement reads as follows:

" JOINT AFFIDAVIT

We, Lokeshwar @ Lokeshwara, S/o.B M Padmanabha, Aged about 29 years and Pinki Pahari, W/o Lokeshwara, Aged about 30 Years, both are r/at, No.33, Ramanashree Layout, Phase 2, Doddakammanahalli, Bangalore - 577076 do hereby solemnly affirm and state on oath as follows:

We are petitioners in the above petition and we know the facts and circumstances of the and hence we swearing to this affidavit.

We state that, due to enmity and personal fight between with Petitioner No.2, the Respondent No.2 was forced to lodge a written complaint on 29.12.2023 before the Hulimavu Police Station against us and same was registered as Crime No.0600/2024. Further, the investigation officer has filed final report in CC.No.28998/2024 and the same is pending on the file of the IX th Addl Chief Judicial Magistrate court Bangalore.

We state that with the intervention of the elders and well-wishers the 2nd Respondent and we have entered into a compromise wherein we have settled all our misunderstandings.

We state that in view of the above said compromise we hereby request this Hon'ble Court to compound and acquit us for the offence punishable under Section 34,354 of Indian Penal Code and same is registered as Crime No.600/2024. We further state that after investigation the police have filed final report in C.C.No.28998/2024 and the same is pending on the file of the IX th Addl Chief Judicial Magistrate court Bangalore.

We further state that, due to some misunderstanding above case filed against if processing or quashed the Respondents will not sustain any injury or loss.

We state that, we prays that this Hon'ble Court be please to permit us to compound the above said offences and record the compound by acquitting the us by allowing this petition,

We further state that, we declare this affidavit filed us in my own accord without any compulsion, fear, threat or force and there is no collusion.

(ii) Proceedings pending in C.C.No.28998/2024 pending before the IX Additional Chief Judicial Magistrate Court, Bangalore, against the petitioners stands quashed.
