This petition is filed by accused Nos.1 to 4 under

Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023

praying to grant anticipatory bail in Crime No.8/2025 of

Channapatna Rural Police Station registered for the offences punishable under Sections 115(2), 118(1),

351(2), 352 and 76 read with Section 3(5) of Bharatiya Nyaya Sanhita, 2023.

Heard the learned counsel for petitioners and the learned High Court Government Pleader for the respondent/State.

The learned counsel for petitioners would contend that on a complaint filed by one of the petitioners, a case has been registered against the complainant and others in Crime No.7/2025. As a counter, a complaint has been filed and registered in Crime No.8/2025. There was a quarrel with respect to a civil dispute pending in OS No.29/2025 between two groups in which two persons have sustained injuries. The said two persons have sustained only simple injuries. The investigation is over. Charge sheet has been filed and therefore the petitioners are not required for custodial interrogation. With this, he prayed to allow the petition.

Per contra, the learned High Court Government

Pleader for the respondent/State would contend that the petitioners have assaulted with a stick and pulled saree. The two persons have sustained simple injuries. With this, he prayed to reject the petition.

Having heard the learned counsel, the Court has perused the charge sheet and other materials placed on record.

The incident has taken place on 16.01.2025 and FIR came to be registered on 22.01.2025. It is alleged that the petitioners have assaulted CW1 and CW2. CW2 has sustained one simple injury and CW1 has sustained two simple injuries. In the counter case registered in Crime No.7/2025, the accused persons therein have been granted anticipatory bail by this Court. The investigation is over and charge sheet has been filed. The incident has taken place with regard to a civil dispute among the parties. There are no criminal antecedents of petitioners.

Considering the above aspects, the petitioners

have made out a case for grant of anticipatory bail with conditions.

i) The petition is allowed.

ii) The petitioners are ordered to be released on

bail in the event of their arrest in Crime No.8/2025 of

Channapatna Rural Police Station registered for the offences punishable under Sections 115(2), 118(1), 351(2), 352 and 76 read with Section 3(5) of Bharatiya Nyaya Sanhita, 2023 subject to following conditions:

a) The petitioners shall voluntarily appear before the jurisdictional Court within fifteen days from this day and execute bail bond for a sum of Rs.1,00,000/- each with one surety for the like sum to the satisfaction of jurisdictional Court.

b) The petitioners shall not threaten the prosecution witnesses either directly or indirectly.
