The undersigned counsel for the Petitioners most respectfully submits as follows:

It is submitted that the Petitioners have filed the present criminal petition seeking quashing of the FIR in Crime No.459/2025 dated 02.12.2025, registered pursuant to the complaint dated 02.12.2025 by the 1st RespondentHSR Layout Police Station, for the offences punishable under Sections 303(2), 324, 329(3) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023, which was pending on the file of the XXXIX Additional Chief Metropolitan Magistrate, Nrupatunga Road, Bengaluru.

It is further submitted that during the pendency of the present petition, the Respondent No.1 Police have filed a charge sheet in C.C. No.49346/2025 dated 15.12.2025 in respect of the very same crime, thereby rendering the present petition infructuous.

Wherefore, it is most respectfully prayed that this Hon'ble Court may be pleased to permit the Petitioners to withdraw the present petition in Crl.P. No.16963/2025, with liberty to file a fresh petition challenging the charge sheet, in the interest of justice.”
