Heard the learned counsel Sri. Parameshwarappa, appearing for the petitioner, Sri. B.N. Jagadeesha, learned Addl. SPP appearing for respondent No.1 and have perused the material on record.

The petitioner is before this Court, seeking the

following prayer:

" WHEREFORE , in view of the above said facts and circumstances it is most respectfully prayed that this Hon'ble Court be pleased to allow the above petition and pass appropriate orders or directions quashing the criminal proceedings in C.C.No. 10106/2022 in Crime No. 164/2020 for compounding the offences punishable under Sections 406, 419, 420, 465, 506, 120B and 149 IPC of the IPC. Initiated by the respondent No. 1, which is pending on the file of the before the Learned Principal Civil Judge and JMFC at Nelamangala, in the interest of justice."

Learned counsel appearing for the petitioner would submit that the issue in the lis stands covered by the judgment rendered by the Co-ordinate Bench of this Court in Crl.P.No.11442/2022 disposed on 10.01.2023, wherein it has held as follows:

"2. This petition is filed by the petitionersaccused Nos.1 to 3 under Section 482 of the Cr.P.C. for quashing the entire criminal proceedings including the charge sheet in C.C.No.10106/2022 pending on the file of the Civil Judge and JMFC, Nelamangala registered for the offences punishable under Sections 406, 419, 420, 465, 506, 120B and r/w 149 of Indian Penal Code (for short IPC).

During the pendency of this petition, both the petitioners and respondent No.2 have appeared through their respective counsel before the Court and they have filed I.A.No.1/2023 i.e., joint compromise application under Section 482 of Cr.P.C. seeking permission of this Court to compound the offence.

Sri. Rajashekhara Seeri, learned counsel appears for respondent No.2.

Learned counsel also submits that the civil case filed is already compromised and decree has been passed in OS No.75/2021. In pursuance of the settlement, respondent No.2 herein has paid Rs.16,00,000 (Rupees Sixteen Lakhs only) on 12.11.2022 in favour of petitioner No.3

Learned counsel for the respondent No.2 submits that the matter has been settled between the parties. Learned HCGP has no objection for the same.

Submission of both the parties and joint compromise application is taken on record.

Considering the facts and circumstance of the case, since the main offence is compoundable in nature, both the parties have already settled their dispute in the civil case.

Therefore, In view of the settlement arrived at by the parties, I.A.No.1/2023 i.e., joint compromise application is allowed and the parties are permitted to compound the offence.

Consequently, the criminal petition is allowed .

The proceedings against the petitioners-accused Nos.1 to 3 in C.C.No.10106/2022 on the file of the Civil Judge and JMFC, Nelamangala registered for the under Section 406, 419, 420, 465, 506, 120B and r/w 149 of IPC is hereby quashed."

of this Court (supra) and for the reasons aforementioned, the following:
