a) Call for Trial Court records in CC No. 26618/2023 on the file of the 46^th A.C.J.M. at Bengaluru City; for the offences punishable under Sections 354, 323, 341, 506, 504 read with Section 149 of the IPC;

b) Quash entire proceedings against these petitioners in CC No. 26618/2023 on the file of the 46^th A.C.J.M. at Bengaluru City; for the offences punishable under Sections 354, 323, 341, 506, 504 R/w 149 of IPC;

c) Pass any such other relief/s deems fit this Hon'ble Court.

a) To call for records and quash the FIR in Crime No.127/2023 registered by 1^st respondent Chandra Layout police, against the petitioner for the offences punishable under section 498A of IPC read with 3 & 4 of Dowry Prohibition Act, pending on the file of the VIII Addl. CMM Court, at Bangalore, against the petitioner;

It is submits that, the second respondent lodged complaint before the Chandra Layout police, Bengaluru. The Chandra Layout police have registered case in Crime No.97/2023 dated: 04.04.2023 for the offence punishable under Sections 354, 323, 341, 506, 504 R/w 149 of IPC.

It is submitted that, the respondent No.1 police have investigated the matter and filed the charge sheet against the accused No.1 to 5 for the offences punishable under Sections 354, 323, 341, 506, 504 R/w 149 of IPC and accused No. 6 to 8 are dropped in the charge sheet. The Ld. Magistrate took the cognizance and registered Criminal case in C.C.No.26618/2023 pending on the 46^th Addl. Chief Judicial Magistrate at Bengaluru.

It is submits that, the 1 petitioner Chaya and Harshith (son of 2^nd respondent) are husband and wife, Harshith has filed the M.C petition before the Hon'ble 5^th Addl. Prl. Judge Family Court at Bengaluru, in M.C No.6952/2023 seeking for divorce under Hindu Marriage Act, and Chaya filed counter claim for restitution of conjugal rights. Thereafter, the matter was referred to the Mediation Center, 1^st petitioner and her husband Harshith were settled the dispute amicably before the mediation in MC No.6952/2023. 1^st petitioner and her husband are reunion and they are living happy matrimonial life.

It is submitted that, the petitioner No.1 and her husband Harshith (2^nd petitioner's son) are entered into memorandum of settlement under Section 89 of CPC R/w Rules 24 & 25 of the Karnataka Civil Procedure (Mediation) Rules, 2005. The parties are agreed to quash the proceedings in CC No.26618/2023 (Crime No.97/2023) on the file of the 46^th ACJM, Bengaluru City.

It is submitted that, 1^st petitioner agreed withdraw case against 2^nd respondent and her family members in CC No. 18604/2024 (Crime No.127/2023) and also co-operate the 1st petitioner agreed to cooperate for the close or quashing of the said criminal case against the all the accused persons in the said case, which is pending before this Hon'ble 46th ACJM Bengaluru and Crl.Petn. No.4094/2023 pending before this Hon'ble Court.

It is submitted that, the offence is not punishable exclusively death or imprisonment for life and the offence is not affect to the society. The petitioner and Harshith (son of respondent No.2) are settled the dispute at the intervention of well-wishers, elders, family friends of the both families and friends, elders of both the families.

It is submitted that, if the application is not allowed by this Hon'ble Court the parties will be put to great hardship and injury. On the other hand no hardship will be caused.

WHEREFORE, the Petitioners pray that this Hon'ble Court be pleased to allow the application and quash the entire proceedings against the petitioners in C.C. No.26618/2023 (in Crime No.97/2023) on the file of the Hon'ble 46th ACJM, Bengaluru, for the offence punishable under Sections 354, 323, 341, 506, 504 R/w 149 of IPC, in the interest of justice.

It is submits that, the First Petitioner and Second Respondent are husband and wife, First Petitioner (Harshith) has filed the M.C. petition before the Hon'ble Vth Addl. Judge, Family Court, at Bengaluru, in M.C No.6952/2023 seeking for divorce under Hindu Marriage Act, and Chaya filed counter claim for restitution of conjugal rights. Thereafter, the matter was referred to the Mediation Center, where first petitioner and second respondent, settled the dispute amicably before the mediation in MC No.6952/2023 dated 06-11-2025. first petitioner and second respondent got reunion and they are living happy matrimonial life.

It is submitted that, first petitioner and second respondent entered into memorandum of settlement under Section 89 of CPC R/w Rules 24 & 25 of the Karnataka Civil Procedure (Mediation) Rules, 2005. The parties are agreed to quash the proceedings in CC No. 18604/2024 (Crime No. 127/2023) on the file of the XLVI Addl Chief Judicial Magistrate, At Bengaluru.

It is submitted that, second respondent agreed to withdraw case against first petitioner and his family members in CC No. 18604/2024 (Crime No.127/2023) and also co-operate for the closing or quashing of the said criminal case against the all the accused persons in the said case, which is pending before Hon'ble XLVI Addl Chief Judicial Magistrate, At Bengaluru.

It is submitted that, the Petitioner has returned gold articles weighted 40 grams to the second respondent. further agreed that both families siblings should not interfere in their family life. It is further undertaken by the Second Respondent that she shall not repeat similar behavior in future and maintain a cordial and harmonious with the Petitioners and their family members; It is further submitted that the Second respondent and her

family members shall not interfere in the property matters of the petitioners and their family members.
