This petition is filed by sole accused under Section 483 of BNSS praying to grant bail in Crime No.191/2025 of Akkur Police Station registered for offences under Section 105 of BNS.

Heard learned counsel for petitioner and the learned HCGP for respondent/State.

Learned counsel for petitioner would contend that

the allegation against the petitioner is that he drawn a line from his transformer situated in the land of his mother to safeguard the crop from wild pig. The deceased, who went in search of his cattle, touched the said live wire and died due to electric shock. He further submits that there was no any intention on the part of the petitioner. There are no criminal antecedents of the petitioner. The petitioner is an agriculturalist. As charge sheet is filed, the petitioner is

not required for custodial interrogation. With this, he

prayed to allow the petition.

Per contra , learned HCGP would contend that petitioner, without taking any safety measures, has drawn line from transformer situated in his land to protect his crop. There is a negligent act on the part of the petitioner which caused the death of the deceased. The charge sheet material show prima-facie case against the petitioner. With this, she prayed to reject the petition.

Having heard the learned counsels, the Court has perused charge sheet and other materials placed on record.

As per charge sheet, the allegation against the petitioner is that he has drawn a line from transformer situated in the land in the name of his mother without taking any precautions and deceased who went in search of his cattle touched the said live wire and died of electric shock. Considering the said aspect, whether the petitioner

was negligent and has not taken any safety measure which caused the death of deceased is to be ascertained at trial. As the charge sheet is filed the petitioner is not required for further custodial interrogation. There are no criminal antecedents of the petitioner.
