This petition is filed by sole accused under Section 439 of Cr.P.C praying to grant bail in S.C.No.1445/2025 (Crime No.156/2024 of Malleshwaram Police Station) registered for offences punishable under Sections 406, 420, 417, 120B, 376, 506 and 34 IPC, pending on the file LIII Additional City Civil and Sessions Judge, Bengaluru.

Heard the learned counsel for petitioner and

learned HCGP for respondent/State.

Learned counsel for petitioner would contend that there was a financial transaction between petitioner and the complainant and they intended to purchase a property. With regard to the said aspect dispute arose between them and therefore, a false complaint has been filed against the petitioner. In the averments of the complaint

there is no allegation of any forcible sexual intercourse by this petitioner on the victim. The victim is aged 28 years. The alleged sexual intercourse is consensual. The petitioner who has received Rs.48,00,000/- from the complainant is ready to repay the same after he receives back the amount which he has given to the prospective vendor under registered sale agreement. As the charge sheet is filed, the petitioner is not required for custodial interrogation. With this, he prays to allow the petition.

Per contra, learned HCGP would contend that this petitioner is married to one Pavithra. The petitioner is making believe the other ladies that he is unmarried and under the promise of marriage he had sexual intercourse and cheated them. The petitioner in all received Rs.1Crore 10 lakh from the complainant and cheated her. The charge sheet material shows prima-facie case against the petitioner. The petitioner is involved in similar cases and he is having criminal antecedents. With this, he prayed to reject the petition.

Having heard the learned counsel, the Court has perused the charge sheet and other materials placed on record.

As per averments of the complaint, the petitioner came in contact with the victim lady through shaadi.com.

Thereafter, they continued their relationship and had sexual intercourse. It is alleged that the petitioner had received money from the complainant and did not repay and threatened her that he will upload her photos in social media if she demands repayment of the money. The offences alleged against the petitioner are not punishable either with death or imprisonment for life. As the charge sheet is filed, the petitioner is not required for custodial interrogation. The petitioner is in judicial custody since 10.04.2025. The petitioner has undertaken to appear before the trial Court on all dates of hearing. The petitioner has also undertaken that he will repay Rs.48,00,000/- to the complainant after he gets back the said amount where he has invested.
