This petition is filed by sole accused under Section

483 of BNSS praying to grant bail in a Cr.No.203/2025 of Pavagada Police Station registered for offences under Sections 124(1), 109 of BNS.

Heard learned counsel for the petitioner and

learned HCGP for respondent/State.

Learned counsel for the petitioner would contend that there was no intention on the part of the petitioner to commit alleged offence. The injured has sustained 12 to 15% of burn injuries. The said burns are not on vital part. The investigation is over. Charge sheet has been filed. The

petitioner is in judicial custody since 15.09.2025. There are no criminal antecedents of the petition. With this, he prayed to allow the petition.

Per contra , learned HCGP would contend that the injured has asked the petitioner to wait for supply of kabab ordered by him, as there are other customers who have ordered earlier. Enraged by that, this petitioner took the boiling oil and threw it on CW2 and caused burn injuries on her right shoulder, near chest and on her back. The injured is a lady, aged 36 years. Without any rhyme or reason, the petitioner has committed the act and the victim is suffering with the burn injuries. The said injuries are found to be grievous in nature. With this she prayed to reject the petition.

Having heard learned counsels, the Court has perused the charge sheet and other materials placed on record.

The case of the prosecution as per charge sheet is that CW1 and CW2 were running a kabab center and the petitioner went there and ordered for supply of kabab and at that time, CW.2 asked him to wait as customers are waiting who have ordered earlier. Enraged by that the petitioner told that there is no fear of him and took the boiling oil in kadai and threw it on the body of CW2 and caused burn injuries on her right hand, left shoulder, near chest and back.

The wound certificate of CW.2 indicates that she has sustained superficial to deep partial second degree burn injuries to the extent of 12 to 15%. The doctor has opined that the said injury is grievous in nature. The offence alleged against the petitioner is punishable with imprisonment for life. Without any reason, the petitioner has made CW2 to sustain burn injuries. If the petitioner is granted bail, there is threat to CW1 and CW2 and other prosecution witnesses.
