2. Heard the arguments of learned counsel for the

petitioner.

3. This transfer petition is filed by wife for transfer of G&WC No.1/2025 filed by husband for declaring him as guardian of the minor child before the Senior Civil Judge and JMFC., Malur to the Family Court at Bengaluru.

4. The counsel of the petitioner stated that the

marriage of petitioner with respondent was performed on 02.07.2017 and a male child was born on 28.08.2021 and the

child is with the petitioner at Bengaluru. Therefore, filing of G and WC No.1/2025 before the Senior Civil Judge and JMFC., Malur is without jurisdiction.

5. Admittedly, guardian case is to be filed where the child resides. Therefore, the filing of G & WC before the said Court itself is not proper and it can be transferred to the proper Court. Therefore, this Court finds it is just and reasonable to transfer G&WC No.1/2025 from Senior Civil Judge and JMFC., Malur to Family Court at Bangalore. Ordered accordingly.

6. In the result, the petition is allowed .

Pending IA is closed in view of disposal of the main petition.
