The complainant has filed the present complaint alleging

willful disobedience of an interim order dated 15.12.2023 passed by the learned Single Judge in W.P. No.25723/2023. By virtue of the said interim order, the order dated 11.08.2023 passed by the Tribunal of Maintenance and Welfare of Parents and Senior Citizens and Assistant Commissioner, Bengaluru South SubDivision at Bengaluru in Case No.MSC/CR/30/2022-23 was stayed.

It is material to note that in terms of the said order dated 11.08.2023, the gift deeds dated 30.05.2019 were declared null and void.

The learned counsel for the complainant submits that, by virtue of the interim order dated 15.12.2023, the accused did not have any right to execute any gift deed. Notwithstanding the subsistence of the said interim order, the accused has proceeded

on the premise that the earlier gift deeds had been declared null and void, and has executed another gift deed.

The question as to whether the gift deed dated 30.05.2019 allegedly executed by the accused is valid or not is a separate issue to be decided independently. However, under the interim order dated 15.12.2023, no directions were issued to the accused. Therefore, we are unable to accept that any proceedings under the contempt of Courts Act, 1971 are required to be initiated for

disobedience of the interim order dated 15.12.2023.
