This contempt petition is filed alleging willful disobedience

¶31

of the order of the learned Single Judge dated 13.03.2023, passed in W.P.No.34242/2014.

The operative portion of the order is extracted below:

"However, taking into consideration the prayer made in the writ petition, seeking relief of regularization/absorption of the services of the petitioner, I am of the view that, it is open for the petitioner to approach the respondent-Authorities by way of representation for such relief claimed in the writ petition. In the event, if such representation is made by the petitioner within two weeks from the date receipt of this order, respondent No.2-Society shall consider the same in accordance with law, inter-alia consider the payment of arrears of salary, if any, to be payable to the petitioner by the respondent No.2-Society within an outer limit of eight weeks from the date of receipt of such representation made by the petitioner. With these observations, writ petition stands disposed of."

The petitioner/complainant herself has produced an endorsement dated 11.08.2023, which was issued by the accused, wherein the request of the complainant for regularization was rejected.

The respondent/accused has filed an affidavit

indicating that the complainant is employed as a contract employee through agency on out source and a communication is sent to the Principal, Morarji Desai Residential School, Bengaluru, to get the amount released in favour of the complainant.

Taking note of the nature of the direction issued by the learned Single Judge, we are of the considered view that there is no willful disobedience of the order of the learned Single Judge. The representation of the complainant has been considered. Accordingly, contempt proceedings are dropped , keeping open all the contentions to be adjudicated by the complainant in appropriate proceedings. Notice issued to the accused shall stand discharged.
