The complainants have filed the present complaint alleging willful disobedience of the order dated 20.02.2025 passed in Writ Petition No. 26856/2024 [GM-RES-PIL].

It is the complainants case that there is a public road passing through the house of one Govindappa to the garden land of Seenamma in Sy. No. 28/1 of K.Haravesandra Village, C.S.Pura Hobli, Gubbi Taluk, Tumakuru District. It is stated that the said road had been dug up. In the aforesaid context, this Court had observed that is for the concerned authorities to look into the said complaint and for the Tahsildar, Gubbi, to take suitable action. Liberty was given to the complainants to pursue the representation or make a fresh representation to the Panchayat authorities, who were required to look into the same and if required, take necessary remedial action.

The accused have now since handed over a memo enclosing therewith two endorsements dated 04.12.2025 and 07.01.2026 which indicates that the complainants representations have been considered.

In view of the above, we do not consider it apposite to initiate any proceedings under the Contempt of Courts Act, 1971. The complaint is closed. However, the complainants are at liberty to avail of substantive remedies with respect to their grievance regarding alleged encroachment of the road, albeit in accordance with law.
