In this writ petition, the petitioners have sought for a writ of certiorari and to quash the order dated 10.05.2013 passed in R.R.T (TH) C.R 459/2012-2013 as per Annexure - K and also sought for writ of mandamus directing respondent No.2 to consider the representation dated 26.11.2012 at Annexure - J.

The grievance of the petitioners is that, petitioner - Smt.Chinna Papamma had purchased the land bearing Sy.no.23 measuring 5 acres and Sy.no.8 measuring 24 guntas situated at Chikkanahalli, Taverekere Hobli, Bangalore South Taluk vide sale deed dated 01.05.1968. Ever since from the date of purchase, she was in possession of the said land. Subsequently, respondent No.2 – Tahsildar, Magadi Taluk made an attempt to dispossess the petitioner on the basis of Karnataka Ordinance No. 31 of 1975, the Karnataka Village Officers Abolition Act (Amendment) dated 24.12.1975. Against which, the petitioner filed a writ petition in WP No.6588/1976 before this Court and this Court rejected

the petition of the petitioner vide order dated 18.10.1976. Subsequently, the land was re-granted in favour of vendor of the petitioner dated 28.07.2007.

It is the contention of the petitioner that, even thereafter the petitioner is in possession of the subject land. As such, she approached the Tahsildar by filing a representation as per Annexure – J to grant the land in her favour since she was in possession of the subject land. The said application was not considered by the Tahsildar. Hence, she filed this writ petition.

Heard Sri.N.Nagaraja, learned counsel for the petitioners, Sri.Neelakantappa K.Pujar, learned High Court Government Pleader for respondents No.1 and 2, Sri.V.B.Shivakumar, learned counsel for respondents No.3, 6, 7 and also for impleading respondent Nos.8 and 9.

It is submitted by the learned counsel for respondents No.3, 6 to 9 that after the re-grant, the original allotteerespondent No.3 and 4 sold the land in favour of respondents No.8 to 9 vide sale deed dated 13.11.2015

and they are in possession of the subject land. Presently, the land comes within the limits of Bruhat Bengaluru Mahanagara Palike. In such circumstances, the consideration of representation of the petitioner does not arise.

Having considered the contention, so also on perusal of the documents, since the lands in question after regranting in favour of the vendor of the petitioner i.e. respondent No.3 and 4 was sold by them in favour of respondents No.8 and 9, I am of the considered view that the question of considering the representation of the petitioner does not arise.

If the petitioners are aggrieved in any manner, they are at liberty to approach the appropriate authorities by initiating appropriate proceedings in accordance with the law. Accordingly, writ petition is disposed of.
