ORAL ORDER

The Petitioner is before this Court seeking for the following reliefs:

a. Issue a writ in the nature of mandamus directing the R-4 shall registered a criminal case against B Muniswamy Alias Anayappa S/O Late Muniga Alias Bola, Santhosh S/O Anayappa S/O Muniswamy and Smt. Munilakshmamma W/o V.Muniswamy Alias Anayappa vide Annx-F dtd 07.11.2025 forthwith.

b. Issue a writ in the nature of mandamus directing the R-2 and 3 to hold a disciplinary actions against the r-4 for negligence not registering criminal case against B.Muniswamy Alias Anayappa S/o Late Muniga Alias Bola, Santhosh S/o Anayappa Alias Muniswamy and smt. Munilakshmamma w/o B. Muniswamy Alias Anayappa forthwith.

c. Issue a writ or order or direction as this Hon'ble Court deems fit under the circumstances of the case in the interest of justice and equity..

The grievance of the Petitioner is that a complaint

which had been lodged/submitted by the Petitioner

on 07.11.2025 has not been acted upon by the respondents and an FIR has not been registered.

A perusal of the acknowledgement issued by the Respondents would indicate that, even according to the Petitioner, there is a suit in O.S.No.206/2023 pending between the Petitioner and the persons against whom the complaint has been filed. The Respondents have only indicated that only if an order is passed by the said Court, action would be taken.

Learned counsel for the Petitioner submits that there is an order of injunction which has already been granted in favour of the Petitioner in O.S.No.206/2023.

If that be so, it is always available to the Petitioner to file an application before the said Court seeking for police protection, which, if granted, the Respondents would be duty bound to provide.
