This writ petition is filed under Articles 226 & 227 of

the Constitution of India, seeking the following relief:

“Issue a writ of mandamus and direct the respondents to pay the arrears of salary to the petitioner from 1.4.2021 and treat the selection of the petitioner on par with similarly appointed persons in the finance department of the BDA vide Annexures D and E.”

The case of the petitioner is that, he was appointed

on contract basis in the third respondent – Authority as Assistant Engineer. The petitioner is working in BDA in the Office of the Assistant Executive Engineer (Housing Project Sub-Division No.2), on contract basis from 01.04.2021. From that day, he was working as Assistant Engineer. But, till today, his salary has not been paid. Hence, he submitted a representation vide Annexure-D dated 23.12.2021. Since the said representation was not considered, he made one more representation vide Annexure-E, dated 30.03.2024 to respondent No.3. So far, the said representation is not considered. Hence, the petitioner is before this Court.

Sri K.Krishna, the learned counsel for the respondents – BDA submits that, if this Court grants some reasonable time, the representation would be considered in accordance with law.

In view of the above, the respondent No.3 is directed to consider the representation submitted by the petitioner vide Annexure-E dated 30.03.2024, in accordance with law, as expeditiously as possible, not later than eight weeks from the date of receipt of a copy of this order.
