The petitioner has approached this Court seeking the following reliefs:

“Wherefore, the Petitioner above pray that this Hon'ble Court may be pleased to grant the following reliefs;

a. Issue a Writ of Mandamus directing the Respondent No.3 to consider the Representation of the Petitioner dated:24.12.2024 as per ANNEXUREF; and

b. Issue a direction to Respondent No.2Developemntal Officer-3, KIADB Zonal Office, KIADB to act pursuant to the letter/communication of the Respondent No.3-SLAO, KIADB dated: 08.01.2025

Heard the learned counsel for the petitioner and learned counsel for the respondents. Perused the material on record.

The petitioner claims to be the grantee of land

in Sy. No.21/P22 (old Sy. No.21), measuring 4 acres, situated at Kavadadasahalli Village, Channarayapatna Hobli, Devanahalli Taluk, Bengaluru Rural District, pursuant to a saguvali chit dated 17.08.1987. The said land was acquired by the respondents.

The petitioner submitted a representation to the

respondent-authority seeking allotment of the developed land in lieu of the compensation for the acquired land.

On receipt of the representation, respondent

No.3-SLAO, KIADB has addressed a letter to respondent No.2-Development Officer-3 forwarding all relevant documents and directing to take necessary action to allot the developed land to the petitioner’s acquired land.

Learned counsel for the petitioner submits that said communication issued by respondent No.3-SLAO, respondent No.2 has not acted upon the same, resulting continued inaction, thereby compelling the petitioner to approach this Court by filing the present writ petition.

Learned counsel for the respondents submits

that the petitioner’s representation is under active consideration and that appropriate orders would be passed within a reasonable time.

The grievance of the petitioner would stand redressed, if appropriate directions are issued to the respondents. Accordingly, this Court pass the following:

Respondent No.2 is directed to consider the petitioner’s representation dated 24.12.2024 (Annexure-F), bearing in mind the letter addressed by respondent No.3-SLAO and pass appropriate orders within a period of eight weeks from the date of receipt of a certified copy of this order, subject to the availability of the developed land.
