The petitioners have presented this Writ Petition

seeking the following reliefs:

" (a) Issue a Writ of Mandamus or any other appropriate writ or order or direction, directing the respondents No.1, 2 and 3 to generate the

registration numbers of petitioner No.2 to 7 in General Nursing and Midwifery (GNM) admitted in the 1^st petitioner's Institute of Nursing Science for the academic year 2023-2024;

(b) Issue an order or direction directing the respondents No.2 and 3 to permit petitioner No.2 to 6 to appear for Annual Examination scheduled by the respondent no.3 as per Annexure-A, dated 29.01.2025 vide no. KSDNEB/EST/62/2024-25, in General Nursing and Midwifery (GNM);

(c) to award costs of proceedings

(d) And to pass such other order/s as this Hon'ble Court deems fit to grant in the facts and circumstances of the case."

2. Perusal of the material on record would indicate that

the issue in controversy involved in the present petition is directly and squarely covered by the Order of this Court in W.P.No.22751/2022 and connected matters disposed of on 25.03.2025 wherein it was held as under:

In W.P.No.22751/2022, the petitioners seek the following reliefs:

“a) Issue a Writ of Mandamus or any other appropriate writ or order or any other appropriate writ or order or direction, directing the Respondent No.2 to generate the registration numbers of petitioner No.2 to 18. as per List of Students in General Nursing and Midwifery (GNM) admitted in the 1^st Petitioner’s school for the academic year 2021-22;

b) Issue an order or direction, directing the respondent No.2 to permit petitioner No.2 to 18 to appear for Annual Examination scheduled by the respondent No.2 as per Annexure-E dated 29.10.2022 in General Nursing and Midwifery (GNM).

d) And to pass such other order/s as this Hon’ble Court deems fit to grant in the facts and circumstances of the case, to meet the ends of justice.”

2. In W.P.No.22564/2022, the petitioners seek the following reliefs:

“a) Issue a Writ of Mandamus, directing the Karnataka State Diploma in Nursing Examination Board, Respondent No.2 herein, to generate the Registration numbers of Petitioners 2 to 31 and approve their admissions forthwith.

b) Direct the Karnataka State Diploma in Nursing Examination Board, Respondent No.2 herein to permit Petitioners 2 to 31 to take up the 1^st Year GNM Course Final Examinations scheduled to commence from 22.11.2022.

c) Grant such other relief’s as this Hon’ble Court would be pleased to grant in the circumstances of the case, in the interest of justice and equity.”

3. In W.P.No.22774/2022, the petitioners seek the following reliefs:

“a) Issue a Writ of Mandamus or any other appropriate writ or order or direction, directing the Respondent No.2 to generate the registration numbers of petitioner No.2 to 41. as per List of Students in General Nursing and Midwifery (GNM) admitted in the 1^st petitioner’s school for the academic year 2021-22;

b) Issue an order or direction, directing the respondent No.2 to permit petitioner No.2 to 41 to appear for Annual Examination scheduled by the respondent No.2 as per Annexure-E dated 29.10.2022 in Genera. Nursing and Midwifery (GNM),

c) to award costs of proceedings;

d) And pass such other order/s as this Hon’ble Court deems fit to grant in the facts and circumstances of the case, to meet the ends of justice.”

4. In W.P.No.22794/2022, the petitioners seek the

following reliefs:

“a) Issue a Writ of Mandamus or any other appropriate writ or order or direction, directing the Respondent No.2 to generate the registration numbers of petitioner No.2 to 17. As per List of Students in General Nursing and Midwifery (GNM) admitted in the 1^st Petitioner’s school for the academic year 2021-2022;

b) Issue an order or direction, directing the respondent No.2 to permit petitioner No.2 to 17 to appear for Annual Examination scheduled by the respondent No.2 as per Annexure-E, dated 29.10.2022, in General Nursing and Midwifery(GNM),

5. In W.P.No.22815/2022, the petitioners seek the following reliefs:

“a) Issue a Writ of Mandamus or any other appropriate writ or order or direction, directing Respondent No.2 to generate the registration numbers of petitioner No.2 to 24 as per List of Students in General Nursing and Midwifery (GNM) admitted in the 1^st Petitioner’s school for the academic year 2021-22;

b) Issue an order or direction, directing the respondent No.2 to permit petitioner No.2 to 24 to appear for Annual Examination scheduled by the respondent No.2 as per Annexure-E, dated 29.10.2022, in General Nursing and Midwifery (GNM),

c) To award costs of proceedings;

6. In W.P.No.22857/2022, the petitioners seek the

following reliefs:

“(i) Issue a writ in the nature of mandamus directing the respondents to approve the list of 30 students which is not being approved by the respondents;

(ii) Issue a writ of mandamus directing the respondents to consider representation made by the petitioner together with the list of 30 students vide Annexure-C;

(iii) Issue any writ in the nature of mandamus directing the respondents to accept the approval fee / examination fee and permit the student petitioners whose admissions are kept in abeyance by the respondents;

(iv) Issue any writ or order as deemed fit in the facts and circumstance of the case, in the interest of justice and equity.”

7. In W.P.No.23133/2022, the petitioners seek the following reliefs:

“(i) Issue a writ of mandamus directing the respondent Board to consider and approve the admissions of the petitioner students 2 to 6;

(ii) Issue a writ in the nature of mandamus directing the respondent Board to issue hall ticket by accepting the approval / examination fee and permit the petitioner students 2 to 6 to take up the 1^st year GNM examination scheduled to commence from 22.11.2022 vide Annexure-F;

(iii) Issue a writ in the nature of mandamus directing the respondents to consider the representations made by the 1^st petitioner in the interest of the students vide Annexure-C, D & # respectively;

(iv) Pass any order or issue any direction this Hon’ble Court deems fit under the facts and circumstances of the case.”

8. In W.P.No.23136/2022, the petitioners seek the

following reliefs:

“(i) Issue writ of mandamus directing the respondent Board to consider and approve the admissions of the petitioner students 2 to 9;

(ii) Issue a writ in the nature mandamus directing the respondent Board to issue hall ticket by accepting the approval / examination fee and permit the petitioner students 2 to 9 to take up the 1^st year GNM examination scheduled to commence from 22.11.2022 vide Annexure-F;

(iii) Issue a writ in the nature of mandamus directing the respondents to consider the representations made by the 1^st petitioner in the interest of the students vide Annexure-C, D & E respectively;

9. In W.P.No.23137/2022, the petitioners seek the following reliefs:

“(i) Issue a writ of mandamus directing the respondent Board to consider and approve the admissions of the petitioner students 2 to 11;

(ii) Issue a writ in the nature of mandamus directing the respondent Board to issue hall ticket by accepting the approval / examination fee and permit the petitioner students 2 to 11 to take up the 1^st year GNM examination scheduled to commence from 22.11.2022 vide Annexure-F;

(iii) Issue a writ in the nature of mandamus directing the respondents to consider the representations made by the 1^st petitioner in the interest of the students vide Annexure-C, D & E respectively, dated 01.04.2022, 08.04.2022 and 20.04.2022.”

10. In W.P.No.23138/2022, the petitioners seek the

following reliefs:

“a) Issue a Writ of Mandamus, directing the Karnataka State Diploma in Nursing Examination Board, Respondent No.2 herein, to generate the Registration numbers of Petitioners 2 to 31 and approve their Admissions forthwith.

b) Direct the Karnataka State Diploma in Nursing Examination Board, Respondent No.2 herein to permit petitioners 2 to 31 to take up the 1^st year GNM Course Final Examinations scheduled to commence from 22.11.2023.

c) Grant such other relief’s as this Hon’ble Court would be pleased to grant in the circumstances of the case, in the interest of justice and equity.”

11. In W.P.No.23139/2022, the petitioners seek the

(iii) Issue writ in the nature of mandamus directing the respondents to accept the approval fee / examination fee and permit the student petitioners whose admissions are kept in abeyance by the respondents;

12. In W.P.No.23140/2022, the petitioners seek the

“(i) Issue a writ in the nature of mandamus directing the respondents to approve the list of 90 students which is not being approved by the respondents;

(ii) Issue a writ of mandamus directing the respondents to consider the representations made by the petitioner together with the list of 90 students vide Annexure-C, D & E respectively;

(iii) Issue writ in the nature of mandamus directing the respondents to accept the approval fee / examination fee and permit the student petitioners whose admissions are kept in abeyance by the respondents;

(iv) Issue any writ or order as deemed fit in the facts and circumstance of the case, in the interest of justice and equity.”

13. In W.P.No.23144/2022, the petitioners seek the

“a) Issue a Writ or order or direction in the nature of mandamus, directing the respondents to approve the admissions of the petitioners No.2 & 3 to the petitioner No.1 College for Diploma in General Nursing and Midwifery course vide Annexure-‘D’.

b) Further be pleased to, grant any other relief or reliefs that this Hon’ble Court may be pleased to grant in the facts and circumstances of the case and in the interest of justice and equity.”

14. In W.P.No.23146/2022, the petitioners seek the

following reliefs:

“a) Issue a Writ of Mandamus, directing the Karnataka State Diploma in Nursing Examination Board, Respondent No.2 herein, to generate the Registration numbers of Petitioners 2 to 31 and approve their Admissions forthwith.

b) Direct the Karnataka State Diploma in Nursing Examination Board, Respondent No.2 herein to permit Petitioner 2 to 31 to take up the 1^st Year GNM Course Final Examinations scheduled to commence from 22.11.2022.

c) Grant such other relief’s as this Hon’ble court would be pleased to grant in the circumstances of the case, in the interest of justice and equity.”

15. In W.P.No.23386/2022, the petitioners seek the

following reliefs:

“a) Issue a Writ or order or direction in the nature of mandamus, directing the respondents to approve the admissions of the petitioner’s college 40 students for Diploma in General Nursing and Midwifery course for the year 2021-22 vide Annexure-‘D’.

b) Further be pleased to, grant any other relief or reliefs that this Hon’ble Court may be pleased to

16. In W.P.No.23387/2022, the petitioners seek the

following reliefs:

“a) Issue a Writ or order or direction in the nature of mandamus, directing the respondents to approve the admissions of the petitioner’s college 27 students for Diploma in General Nursing and Midwifery course for the year 2021-22 vide Annexure-‘D’.

b) Further be pleased to grant any other relief or reliefs that this Hon’ble Court may be pleased to grant in the facts and circumstances of the case and in the interest of justice and equity.”

17. Since common questions of fact and law are involved in the present petitions, they are disposed of by this common order.

18. Petitioner No.1 in the petitions are Nursing Schools/Colleges, while other petitioners in these petitions are the students studying in the aforesaid petitionerSchools/Colleges. It is an undisputed fact borne out from the material on record that the aforesaid petitioners- students joined the petitioner-Nursing Schools/Colleges for Diploma in General Nursing and Midwifery (GNM), which is for a period of three years commencing from the academic year 2021-22. Since the petitioners-students were not permitted to take up examinations, they approached this Court by way of the present petitions, during the pendency of which, various interim orders were passed permitted the petitionersstudents to take up examinations.

19. It is also not in dispute that while permitting the petitioners-students to take up examinations, the concerned respondents issued a temporary registration number for taking up examinations. It is an undisputed fact as can be seen from the material on record that the examinations taken up by the students during the pendency of the petitions have been passed by them and the petitioners have been declared as passed in the said examinations and the respondents have issued consolidated marks sheets mentioning/stating only the temporary registration numbers, without assigning permanent registration numbers.

In view of the aforesaid facts and circumstances and an undisputed fact that the petitioner took up the examinations as permitted by this Court and successfully passed the same during the pendency of the present petitions, nothing further survives for adjudication in the present petitions, which deserve to be disposed of by issuing certain directions to the respondents for the purpose of enabling the petitioners to proceed further in their career.

21. Accordingly, the Writ Petitions are disposed of.

The concerned respondents are directed to issue marks cards/sheets, consolidated marks cards/sheets, diploma certificates, course completion certificate, documents etc., in favour of the petitioners-students in all the petitions by showing/designating permanent registration number of each student in all the documents, referred to supra, within a period of four weeks from the date of receipt of a copy of this order."

Accordingly, the present petition stands disposed of

in terms of the Order dated 25.03.2025 passed by this Court in W.P.No.22751/2022. The concerned respondents are directed to issue marks cards/sheets, consolidated marks cards/sheets, diploma certificates, course

completion certificate, documents etc. in favour of the petitioners - students by showing/designating permanent registration number of each student in all the documents, referred to supra, within a period of four weeks from the date of receipt of a certified copy of this Order.
