ORAL ORDER

The petitioner has challenged an order bearing No. RGU/EST//2024-25, dated 08.11.2024 by which, he was transferred from Bengaluru to Kalaburgi.

The petitioner was promoted as a Section Officer on 22.07.2022 and was working at the respondent No.1 - University. He is due to retire on 30.11.2025. However, the respondent No.2, who was working as an Assistant Registrar at Kalaburgi has been transferred to the place of the petitioner by virtue of the impugned order dated 08.11.2024. The petitioner is therefore before this Court challenging the order of transfer.

The petitioner contends that the petitioner is sought to be transferred when he is on the verge of retirement without any justifiable reason. He contends that the State Government has formulated transfer guidelines, which provide that an

employee who is on the verge of the retirement should not be transferred. He therefore contends that the impugned order of transfer is without any justification and the same has to be set at naught.

The petition is opposed by the learned counsel for the respondents who contend that the respondents have not adopted the transfer guidelines framed by the State Government. She contends that, Section 13 of the Rajiv Gandhi University Act, 2006 , grants discretionary power to the Vice Chancellor to transfer any person, based on the administrative needs and necessities. Therefore, she contends that the petitioner cannot have any grievance against his transfer.

When this writ petition was listed on 03.12.2024, the petitioner was directed to report to the duty at the transferred location. It was made clear that the petitioner reporting at the transfer location would not render the petition infructuous.

The learned counsel for the petitioner today submitted that the petitioner has reported at the transferred

location and that he has filed representation before the respondent No.1 for cancellation of the transfer order and to repost him at Bengaluru.

The learned counsel for the respondents submits that since the petitioner has reported to the transferred location, the representations of the petitioner would be considered and appropriate orders would be passed within a period of ten days.

In that view of the matter, this writ petition is disposed off , directing the respondents to consider the representations of the petitioner within a period of ten days from today. In case the representations are considered against the petitioner, he shall be entitled to seek revival of this writ petition.
