Service matter (pay anomaly): Writ petition under Articles 226 and 227 of the Constitution of India by a 67-year-old KPTCL employee, whose representations dated 04.09.2023 and 24.09.2024 (Annexures F and G) sought stepping up of pay on par with a junior, Sri M.D. Gururaja, by refixation at Rs.15,025/- instead of Rs.14,585/- with effect from 28.05.2007, with consequential revision of pay and pension. An earlier petition (WP No.3216 of 2022) had been allowed on 22.08.2023 directing consideration of those representations, but the respondents did not comply. Before Ashok S. Kinagi, J., counsel for the respondents submitted that, if reasonable time were granted, the representations would be considered and an appropriate order passed in accordance with law. On that submission, the Court disposed of the writ petition directing the respondents to consider Annexures F and G and pass appropriate order in accordance with law within 8 weeks from receipt of a copy of the order. The prayer had also invoked the order dated 07.12.2020 in WP.27687/2015(S-RES) (Sr.Chikkachallaiah vs. Managing Director, KPTCL), which the Court did not adjudicate upon.

ORAL ORDER

The petitioner filed this writ petition seeking a mandamus directing the respondents to consider the representations dated 04.09.2023 and 24.09.2024, wherein the petitioner requested to extend the pay on par, by refixing the same at ₹15,025/-, instead of his pay of ₹14,585/- vide Annexures F and G. The petitioner aggrieved by the inaction on the part of the respondents filed a writ petition in WP No.3216 of 2022. This court allowed the writ petition and directed the respondents to consider the representations vide order dated 22.08.2023. Despite the direction issued by this court, the respondents have not considered the representations. Hence, this writ petition.

Heard the learned counsel for the petitioner and also learned counsel for the respondents.
