Petitioner is knocking at the doors of writ court for

assailing the State Administrative Tribunal’s order dated 13.03.2024 whereby his Application No.1545/2023 has been negatived. In the said Application he had sought for quashment of Final Select List of Assistant Professors (Management) dated 03.03.2023 wherein his name did not figure and instead names of private respondents did.

Learned counsel for the petitioner vehemently argues that his client possesses the prescribed educational qualification inasmuch as he has an MBA Post Graduate Degree with BBM Degree besides a pass in KSET Examination in Management. Learned AGA appearing for the official respondents vehemently resists the petition making submission in justification of impugned order of the Tribunal and the reasons on which it has been constructed. He adds that the NET/SLET is required to be in Commerce since what is being selected is to the post of Assistant Professor in Commerce.

Having heard the learned counsel for the parties

and having perused the petition papers, we find that the petitioner does not have the requisite educational qualification, although he has all the educational degrees which he has asserted before the Tribunal and before us.

The Tribunal at para 12 of its order has observed

as under and we fully endorse the same:

“12. In the instant case, it is not at all the case of the learned counsel for the applicant that the respondents 5-6 have not passed their NET / SLET in the relevant subject which is the subject of commerce in which they have obtained PG degree. It is PG Degree in Commerce which is also regarded as fulfilling the eligibility requirement for Assistant Professor of Management and the respondents 5-6 possess PG Degree in Commerce. Therefore, the NET / SLET requires to be in Commerce subject only where the PG Degree is in Commerce since PG Degree in Commerce is recognised as a subject eligible for being recruited to the post of Assistant Professor in Commerce.”

In the above circumstances, petition being devoid of merits is liable and accordingly rejected, costs having been made easy.
