In this writ petition, the petitioner is assailing the public auction dated 28.03.2023 (Annexure-D), interalia sought for subsequent proceedings.

Heard the learned counsel appearing for the

The petitioner has filed the application along with affidavit dated 31.10.2025 and 04.11.025, stating

that the petitioner has entered into a compromise with the auction purchaser i.e. respondent No.2 and respondent No.1 has received dues and as such, sought for quashing the proceedings. Both the petitioner and respondent No.2 are present before the court and they have been identified by their respective learned counsels. Both the parties submitted that, they have entered into compromise as stated above.

In that view of the matter, since the petitioner

and the respondent No.2, had entered into compromise, and therefore, I am of the opinion that, the public auction dated 28.03.2023 in respect of the schedule property issued by the respondent No.1-Bank be quashed. It is also submitted by the learned counsel for

the petitioner that, if any amount in due, is to be payable to the respondent No.1-Bank, and same shall be paid within an outer limit of two weeks from today. It is also submitted that the petitioner has complied with the

interim order dated 21.08.2023 granted by this court and same has not been countered by the learned counsel for the respondent-Bank. Hence, I pass the following:

i) The writ petition is allowed ;

ii) The impugned public auction dated 28.03.2023 (Annexure-D), is hereby quashed

in respect of the schedule property mentioned in the writ petition. Consequently, all further proceedings made thereunder are hereby quashed.

iii) It is open for the respondent No.1-Bank

to recover dues, if any, as mentioned above.
