IS FILED UNDER ARTICLES 226 & 227 OF THE CONSTITUTION OF INDIA PRAYING TO DIRECT THE RESPONDENT NO.2 TO RELEASE PETITIONERS CONVICT MOHAMMED ALI CTP13685 ON GENERAL PAROLE FOR A PERIOD OF 90 DAYS ON THE GROUND THAT ILLNESS OF PETITIONER WHICH IS EVIDENT AND ISSUED BY THE SAGAR HOSPITAL AND ALSO THE CONVICT WIFE IS CURRENTLY PREGNANT. THE PRESENCE OF CONVICT WHO IS THE SON OF THE PETITIONER IS ESSENTIAL TO PROVIDE MEDICAL CARE FOR EFFECTIVE TREATMENT AND RECOVERY AND TO PROVIDE NECESSARY SUPPORT TO HIS PREGNANT WIFE.

The mother of the detenu is before this Court seeking

for the following reliefs:

a. Direct the respondent no.2 to release petitioners convict Mohammed Ali CTP-13685 on general parole for a period of 90 days on the ground that illness of petitioner which is evident and issued by the Sagar hospital and also the convict wife is currently pregnant. the presence of convict who is the son of the petitioner is essential to provide medical care for effective treatment and recovery and to provide necessary support to his pregnant wife.

b. Pass such other order/s which this court may deem fit and proper under the facts and circumstances of the case in the interest of justice.

Learned AGA submits that the Police Report received

is positive in nature, recommending parole of the detenu for a period of 30 days. She submits that, given a week’s time necessary orders would be passed.
