ORAL ORDER

The petitioner is before this Court seeking for the following reliefs:

¶29

a. Issue writ of mandamus or such other appropriate writ or order directing the respondents to remove the petitioners name i.e., Mr.L.Srinivas from the rowdy sheet of Bangalore City as per Endorsement dated 28.02.2018 issued by the fifth respondent vide Annexure-H

b. Issue a writ of mandamus or such other appropriate writ or order directing the respondents not to interfere with the personal life of the petitioner unreasonably, more particularly without giving any written intimation.

c. Pass such other writ/s or order/s which are deemed to be fit in the nature and circumstances of the case, in the interest of justice and equity.

The grievance of the petitioner is that the petitioner having filed a complaint as regards the establishment of Gas godown by the Bharat Petroleum which resulted in complaints and counter complains including that against the petitioner which resulted in the petitioner’s name being entered into rowdy sheeters list. The allegation made by the petitioner is that such an entry of the name of the petitioner was on account of the complaint which had been raised by

the petitioner. It is in that background that the petitioner is before this Court.

The manner in which a person’s name can be entered to Rowdy Sheeters list has been dealt with extensively by a Coordinate Bench by Judgment dated 22.04.2022 in W.P. No.4504/2021 [ B.S.Prakash -v- State of Karnataka and others] and other connected matters and guidelines have been provided in detail in the said Judgment. It would be required for the respondents to follow the same.

In the present matter, there being no procedural safeguard which has been followed by the respondents in not issuing any notice to the petitioner before including the name of the petitioner in the Rowdy sheeters list, there would be a requirement for necessary direction to be issued to the respondents to comply with the requirements of the aforesaid decision in B.S.Prakash’s case . As such, I pass the following:
