It is submitted by the learned counsel appearing for the respondent that a similar matter in Writ Appeal No.1509/2023 has been dismissed by a judgment dated 12.09.2025 and that the reasons stated in the said judgment apply to the facts of this case as well.

that the question of applicability of the Karnataka Education Act, 1983 to polytechnics' and ITIs' governed by the provisions of the All India Council for Technical Education (for short "AICTE") Act has been considered in the case of D. JEEVAGAN V. THE PRINCIPAL, MEI POLYTECHNIC AND OTHERS
reported in ILR 2007 KAR 4870 , it was held that since the AICTE Regulations do not provide for resolution of disputes raised by employees, such employees of an Institution affiliated to the AICTE would have a right to approach the Educational Appellate Tribunal. Further, the fact that the respondent was an employee of the Institution not being under dispute, and in view of the clear finding of the Tribunal that his services were terminated without holding an enquiry, we are of the opinion that the judgment of the learned Single Judge does not require any interference.
In the result, the writ appeal fails and the same is accordingly dismissed .
