Learned counsel appearing for petitioner has sought permission of the Court to withdraw the petition and to file a petition before the Sessions Court, upon filing of charge sheet.

Petitioner had approached the Sessions Court at crime stage. The learned Sessions Judge while dismissing the bail petition observed that investigation is under progress and major investigation like seizure of material objects and documents have to be made.

In light of the submission of the learned counsel for petitioner and since the charge sheet is now filed, petition is dismissed as withdrawn with a liberty to the petitioner to place entire charge sheet material before the trial Court and to file a fresh petition seeking bail.
