Heard the learned counsel for petitioner and learned HCGP for the State. Perused the material on record.

This petition under Section 482 of BNSS, 2023 is preferred by the petitioner to release him in the event of his arrest in Crime No.80/2024 registered at Terakanambi Police station, Chamarajanagar for offences punishable under Sections 4, 5, 7 and 12 of the Karnataka Prevention of Cow Slaughter and Cattle Prevention Act, 1964.

It is the case of prosecution that on 19.09.2024

at about 8.30 p.m., Police Sub Inspector of Terakanambi Police station received credible information that two

persons are taking about 5-6 cattle from Somanapura Village to Kadathala Hundi village to the slaughter house. He went to the spot at about 10.45 p.m. and arrested the said accused.

It is alleged that the petitioner purchased the cattle for slaughtering and they were being taken by accused Nos.1 and 2 in an inhuman manner to the slaughter house.

Firstly, at this stage there is no material to show that cattle were being taken to the slaughter house. Secondly, on the voluntary statements of accused Nos.1 and 2, present petitioner is arraigned as an accused in the FIR alleging, cattle were purchased by him for the purpose of slaughtering.

Accused Nos.1 and 2 are said to have been enlarged on bail by the learned magistrate. The petitioner

has undertaken to co-operate with investigation of the case. Considering the facts and circumstances, relief

sought for by the petitioner can be granted by imposing conditions.

7. Accordingly, the following:

Petition is allowed .

Petitioner/accused No.3 in Crime No.80/2024 of

Terakanambi Police Station, Chamarajanagar, shall be released in the event of his arrest, subject to following conditions:

¶42

i) He shall appear before the Investigating Officer within one week from the date of receipt of a copy of this order and shall execute a personal bond for a sum of Rs.25,000/(Rupees Twenty Five Thousand only) with one surety for the likesum.

ii) He shall furnish proof of his residential address/contact number and shall inform the I.O. in case of any change in the address/contact number.
