In this petition, petitioner seeks for the following reliefs:-

“Wherefore, the Petitioner herein most humbly pray, that this Hon’ble Court may be pleased to quash the FIR in Crime No.129/2019 of Kengeri PS, for an offence punishable under Sections 420, 465, 467, 468, 470, 471, 473, 120b, 34 of IPC 1860 pending on the file of 56^th Addl. CMM Court, Nrupathunga Road, Bengaluru till disposal of the above petition in the interest of justice and equity.”

Learned counsel for the petitioner – accused No.2 and

learned counsel for 2^nd respondent – complainant have filed an application under Section 320 of Cr.P.C. dated 10.09.2024 duly signed by the petitioner, 2^nd respondent and their respective counsel and the same is taken on record.

Petitioner – accused No.2 and respondent No.2 – complainant and their respective counsel are physically present before the Court and they admit the contents of the aforesaid application, which reads as under:-

The Petitioner and the Respondent No.2 jointly submit before this Hon’ble Court as follows:

1. The Respondent No.2 herein has lodged a complaint before the Respondent No.1 Police which came to be registered in Crime No.129/2019 offence punishable under Sections 420, 465, 467, 468, 470, 471, 473, 120B, 34 of IPC 1860, pending on the file of 56^th Addl. CMM Court, Nrupathunga Road, Bengaluru.

2. The Petitioner and Respondent No.2 submit that at the intervention of well-wishers the Petitioner and Respondent No.2 and Petitioner/Accused No.2 are intending to compound the case and the Respondent No.2 is not intending to proceed further with the case against the petitioner.

3. That, petitioner and Respondent No.2 are friends and they are settling the matter without any condition against each other.

4. The Respondent No.2 further submits that there is no coercion or compulsion on her to compound the offence, but on her own freewill agreed to compound the case. Hence this Application seeking kind permission of this Hon’ble Court to compound the offence.

5. That, the statements made in the accompanying application are true and correct to the best of our knowledge, information and belief and nothing have been concealed nor misrepresented and this our name and signatures.

Wherefore this Hon’ble Court may kindly be pleased to accord permission to compound the offence in Crime No.129/2019 of Kendgeri Police Bengaluru for the offence punishable under Sections 420, 465, 467, 468, 470, 471, 473, 120b, 34 of IPC 1860, pending on the file of the 56the Addl. CMM Court, Nrupathunga Road, Bengaluru, as prayed for therein in the interest of justice and equity.”

In view of the aforesaid settlement entered into between the petitioner and 2^nd respondent, I pass the following:

(i) Petition is disposed of in terms of the application dated 10.09.2024.

(ii) The impugned proceedings in Crime No.129/2019 registered by the 1^st respondent – Police for offences punishable under Sections 420, 465, 467, 468, 470, 471, 473, 120B r/w 34 of IPC, pending on the file of 56^th Addl.CMM, Nrupathunga Road, Bangalore, insofar as the petitioner is concerned are hereby quashed.
