Petitioner is aggrieved by the registration of the FIR in Crime No.282/2025 at Suddaguntepalya Police Station, Bengaluru City, for the offence Punishable under Section 118(1), 351(2) of the BNS, 2023.

It is the contention of the learned counsel that in respect of the incident in question, petitioner has lodged a complaint with the police, on the basis of which a case is registered against the second respondent herein and the FIR in the said case would clearly disclose that it is the petitioner who has sustained injuries in the incident, wherein, he was assaulted with an iron rod on his head, limbs etc. He has therefore, contended that the instant FIR registered against the petitioner is a counter blast and

allowing the proceedings to continue, is an abuse of process of law.

From the material on record, it can be seen that the incident took place on 29.10.2025 at about 10:00 - 10:30 a.m., wherein, both parties lodged complaint, on the basis of which cases are registered against each other. Crime No.282/2025 was registered against the petitioner on a complaint lodged by the second respondent, whereas Crime No.283/2025 is registered against second respondent on a complaint lodged by the petitioner.

In the present case, it is alleged that the petitioner has assaulted the second respondent with hands and stones, in relation to a property dispute, causing injuries to his face, eyes and nose. It is also alleged that the petitioner has threatened the complainant and stated that he will not leave him or his family members to live in Bengaluru.

It is too premature a stage to opine that the

entire allegations in the complaint are false or motivated. Since, there is a case and counter case, the investigation has to be conducted in both the cases. If any adverse report is filed, it is always open for the petitioner to challenge the same, if he is so advised. Petition is dismissed .
