Heard the arguments and perused the material on record.

Petitioner is arraigned as accused No.2 in Crime No.10/2025 of Bengaluru CEN Crime Police Station, Bangalore District, registered for the offence punishable under Section 65, 66, 66(C) of the Information Technology Act, 2008 and Section 335, 336(3) of BNS, 2023.

Complaint is lodged by one Dhanpal Nayak L.S., working as Additional Labour Inspector, Anekal Circle, Bangalore District. FIR is registered against 3 named accused and others. It is averred in the complaint that it is mandatory for the Proprietors of every shop and commercial establishments to register their shops under

Section 4 of the Karnataka Shops and Commercial Establishment Act, 1961 with the necessary application format along with requisite fee. A report was submitted by the technical Assistant of Labour Department to the Labour Commissioner on 07.08.2024, bringing to the notice that registration certificate of Shop and Commercial Establishments have been illegally modified and registration number and registration period and expiry period have been modified using E-labour software.

A perusal of the complaint averments goes to show that the complainant has suspected that the accused named in the FIR have committed the offence by illegally misusing the E-labour software for the purpose of modifying the Registration number, Registration and expiry period.

The allegations made in the complaint have to be established in due course. The complaint appears to have been filed suspecting the accused named in the FIR as the one who committed the offence. The offences

alleged are punishable with a maximum imprisonment of seven years. Petitioner has undertaken to cooperate with

the investigation of the case. Hence, the following:

i. Petition is allowed.

ii. Petitioner/accused No.2 in Crime No.10/2025 of

Bengaluru CEN Crime Police Station, Bengaluru District, shall be released in the event of his arrest, subject to following conditions:

a) He shall appear before the Investigating Officer within one week from the date of receipt of a copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum and shall cooperate with the investigation.
