ORAL ORDER

This petition is filed by the petitioner -accused No.1

under Section 483 of BNSS praying to grant bail in Crime No.13/2025 of Parasurampura Police Station registered for offences punishable under Section 103(1) and 49 of BNS pending in S.C.No.61/2025 on the file of Principal District and Sessions Judge, Chitradurga.

Heard learned counsel for the petitioner and

learned Additional SPP for the respondent -State.

Learned counsel for the petitioner would contend that there are no eyewitnesses to the incident and the case of the prosecution is based on circumstantial evidence. There is no motive on the part of the petitioner to kill the deceased. The petitioner is aged 54 years and

he is in custody since last 09 months. With these, he prays

to allow the petition.

Per contra, learned Additional SPP for the respondent –State would contend that this petitioner as per astrology advice of the accused No.2 in order to gain treasure has killed the deceased. The post mortem report indicates that the deceased has sustained 10 injuries. There is a recovery of machete at the instance of this petitioner and also seizure of clothes of the petitioner. The machete and clothes are found to be blood stained in the FSL report. The cause of death of the deceased is shock and hemorrhage as a result of multiple chop injuries sustained. The charge sheet materials show prima facie case against the petitioner for offences alleged against him. If the petitioner is granted bail, there are chances of he again committing murder of the innocent persons. With this she prayed to reject the petition.

Having heard learned counsels, this Court has

perused charge sheet and other materials placed on the Court.

As per charge sheet the case of the prosecution is that accused No.2 had advised the petitioner -accused No.1 to kill a person and get his blood and to apply the same in Maramma temple to get treasure. In view of the said astrology advice, the petitioner on 09.02.2025 keeping machete on his motorcycle tank went to Parashuram village and found deceased coming in front of him and in the guise of giving him drop took him on his bike and after some distance he stopped the bike and assaulted the deceased on his neck and back with a machete and caused injuries and death.

The post mortem report indicates that the deceased has sustained 10 injuries and cause of death is due to shock and hemorrhage as a result of multiple chop injuries sustained. There is seizure of machete and clothes of the petitioner and on FSL examination, they are found

to be blood stained with human blood of ‘O’ group. The clothes of the deceased were also found to be stained with human origin of ‘O’ blood group.

The above circumstances indicate a prima facie

case against the petitioner. Offences alleged against him

are punishable with death or imprisonment for life. If the petitioner is granted bail, there are chances of tampering the prosecution witnesses and committing similar offence. The petitioner has not made out any grounds for grant of bail.

In the result, the petition is dismissed.
