This petition is filed by the sole accused under Section 483 of BNSS praying to grant bail in Crime No.426/2025 of Hennur Police Station registered for the offence punishable under Section 109 of BNS.

Heard learned counsel for the petitioner and learned Additional SPP and for respondent/State.

Learned counsel for the petitioner would contend that there was quarrel between petitioner and the injured with regard to car parking and in the said quarrel both sustained injuries. Petitioner filed complaint and it is registered in Crime No.427/2025 and complaint filed by the injured has been registered in Crime No.426/2025. The Petitioner has not used any weapon. The incident has taken place in a sudden quarrel. There was no intention on

the part of the petitioner. The petitioner is working as a Medical Officer in a Government hospital. There are no criminal antecedents of the petitioner. The injured has been discharged from the hospital and he is out of danger. The petitioner has voluntarily surrendered before the police. The petitioner is ready to co-operate with further investigation. With this, he prayed to allow the petition.

Per contra , learned Additional SPP would contend that wound certificate indicates that the injured has sustained five injuries. Out of them, three are grievous in nature and two are simple in nature. The investigation is in progress. If the petitioner is granted bail, there are chances of him hampering the investigation and tampering the prosecution witnesses. With this, she prayed to reject the petition.

Having heard the learned counsel, the Court has perused the FIR, complaint and other materials placed on record.

As per case of the prosecution, there was a quarrel between the petitioner and the injured on 26.09.2025 at about 7 p.m. with regard to issue of parking. In the said quarrel the injured has sustained injuries. The assault is stated to have been made by the petitioner by his hands. The petitioner has not used any weapon to assault the injured. The injured has sustained five injuries and he has been discharged from the hospital and out of danger. The petitioner is a Medical Officer in a Government hospital. There are no criminal antecedents of the petitioner. The major portion of the investigation is over. Considering the above aspects, the petitioner has made out case for grant of bail with conditions. In the result, the following:

The petition is allowed. The petitioner is granted bail in Crime No.426/2025 of Hennur Police Station, subject to following conditions:

(i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh) with one surety for the like-sum to the satisfaction of the jurisdictional Court.

(ii) The petitioner shall not tamper the prosecution witnesses either directly or indirectly.

(iii) The petitioner shall attend the Court on all dates of hearing unless exempted and cooperate for speedy disposal of the case.

(iv) The petitioner shall co-operate with IO in further investigation, if any.
