Heard the learned counsel for petitioner, learned High Court Government Pleader for the State and perused the material on the record.

This petition is preferred under Section 483 of BNSS 2023, to enlarge the petitioner on bail in Crime No.84/2025 of Hadadi Police Station, Davanagere, registered for the offence punishable under Section 352, 115(2) and 108 of the BNS 2003.

The aforementioned case is registered on a complaint lodged by one Anjinappa son of late Bheemappa, wherein he has alleged that, he is a resident of Hoovinamadu Village in Davangere. In front of his house, accused is running a beeda shop and illegally selling Liquor. The customers visiting the shop, were always causing nuisance in front of his house and in this regard, when his wife Gangamma (deceased) questioned the accused, she was abused by her. Further, the accused

was telling the deceased to vacate the house etc. It is further alleged that on 05.07.2025 at about 05.30 p.m., accused quarrelled with the complainant's wife, abused her in filthy language, dragged her by her hair, assaulted with hands and kicked her and therefore, being humiliated, his wife committed suicide in her house by hanging herself at around 07.30 p.m.

It is alleged that, the accused quarreled with the deceased, abused and assaulted her and she was telling her to vacate the house etc and therefore, she committed suicide. Whether these acts committed by the accused amounts to abetment or not is a matter to be decided during trial. The prosecution has to establish that the petitioner has intentionally aided or abetted the deceased to commit suicide. The ingredients of the offences alleged have to be proved. Petitioner is a widow having 2 minor children. She was arrested on 10.07.2025. The apprehension of the prosecution that she may tamper with the prosecution witnesses and flee from justice etc.

can be taken care of by imposing necessary conditions.

She is said to be a permanent resident of the address given in the cause title. Hence by imposing suitable conditions, Petitioner can be enlarged on bail. Accordingly, the following:-

i) Petition is allowed.

ii) Petitioner/accused in Crime No.84/2025 of

Hadadi Police Station, Davanagere pending on the file of the Court of III Additional Civil Judge and JMFC Court, Davanagere District, shall be enlarged on bail, subject to following conditions:

She shall execute a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for the likesum to the satisfaction of the jurisdictional Court.
